The plain-language rules for using EstateSaleUSA.

1. What EstateSaleUSA is — and isn't
EstateSaleUSA is software that helps you run your own estate sale: cataloging and pricing tools, a public sale page, entry-time reservations, remote offers, and card checkout. We are not an estate sale company, auctioneer, appraiser, or broker. Sellers run their own sales; buyers purchase directly from sellers. We provide the tools, not the crew.
2. Accounts
You need an account to host a sale or place offers. You're responsible for the accuracy of your account information and for anything done under your login. You must be at least 18 to host a sale. We may suspend or close accounts that violate these terms or abuse the platform.
3. Fees
Hosting a sale costs a one-time $99 setup fee per sale, plus 7% of what sells through the platform, whether the buyer pays by card or cash. Card payments also carry Stripe's standard processing fees, which go to Stripe, not us. Your exact terms are shown and confirmed before you publish a sale; if they ever differ from this page, the terms shown at publish time control.
4. Payments
Card payments are processed by Stripe and go directly to the bank account the seller connects during setup. We never hold or route seller funds. Payment disputes, refunds, and chargebacks are between the buyer and the seller; we'll provide transaction records where we can, but we aren't a party to the sale. Use of Stripe is subject to Stripe's own terms and their Connected Account Agreement.
5. Sellers' responsibilities
If you host a sale, you confirm that you own the items you list or have the legal right to sell them, that your listings are accurate to the best of your knowledge, and that you'll comply with local laws — permits, signage rules, and any taxes owed on your proceeds are your responsibility. You set your own prices and make the final call on every listing and every offer.
6. Buyers
Items at estate sales are used goods sold as-is by the seller. Photos and descriptions are provided by sellers with help from our AI, and reasonable care doesn't make them a warranty. Inspect before you buy where you can. An accepted offer is a commitment to purchase; repeated failure to honor accepted offers can end your account.
7. Scout and AI-generated content
Scout, our AI assistant, suggests prices, titles, and descriptions from photos. These are estimates, not appraisals. For potentially valuable pieces — fine art, jewelry, rare antiques — get an independent appraisal. Sellers review and approve all AI suggestions before publishing and remain responsible for their listings.
8. Acceptable use
Don't use the platform to sell anything illegal, stolen, or recalled; don't misrepresent items; don't scrape, probe, or interfere with the service; don't use it to harass anyone. We may remove content or sales that violate these rules.
9. Our content and yours
You keep ownership of the photos and text you upload, and you give us a license to display them to run your sale page and operate the service. The platform itself — software, design, and the EstateSaleUSA name — belongs to us.
10. Disclaimers and limits
The service is provided "as is." We work hard to keep it available and accurate, but we can't guarantee uninterrupted service, that every item will sell, or any particular sale outcome. To the fullest extent the law allows, our total liability for any claim related to the service is limited to the fees you paid us for the sale in question. We aren't liable for indirect or consequential damages, or for what happens at a sale in person — the sale is in the seller's home and under the seller's control.
11. Ending things
You can close your account anytime. We can suspend or terminate accounts that break these terms. Sections that by their nature should survive (fees owed, liability limits, content licenses for completed sales) survive termination.
12. Changes and contact
We may update these terms as the platform evolves; material changes will be posted here with a new effective date, and continuing to use the service means you accept them. These terms are governed by the laws of the state where EstateSaleUSA operates, without regard to conflict-of-law rules. Questions? Contact us — a person reads every message.
